Sharjah Ruler Introduces New Human Resources Decree-Law

Sharjah: His Highness Sheikh Dr. Sultan bin Mohammed Al Qasimi, Supreme Council Member and Ruler of Sharjah, has recently announced a new decree-law concerning the Sharjah Department of Human Resources.

According to Emirates News Agency, this law impacts all employees within government agencies, including those that currently operate under their own human resources regulations until new guidelines are established. These agencies are required to share essential information such as salaries and other employee details with the Department of Human Resources using approved electronic systems.

The decree-law aims to stay abreast of evolving human resources practices and enhance the work environment, ultimately benefiting society. It establishes a framework for managing human resources in Sharjah, with more detailed regulations to follow. A key component of this initiative is the creation of a permanent "Supreme Committee for Human Resources" within the Sharjah Executive Council. The formation, membership, and operational details of this committee will be determined by the Council, based on recommendations from the Human Resources Department.

The Decree-Law outlines several responsibilities for the Higher Committee for Human Resources. These include studying and interpreting human resources legislation referred by the Council or Department, expressing opinions on matters referred by the Ruler, Council, or Department, and reviewing grievances and complaints from employees. The committee also has the authority to make recommendations to the Council after fulfilling grievance requirements stipulated in the bylaws.

Further, the Decree-Law includes amendments and legal provisions related to the organizational structure, job description and classification system, and the eligibility, conditions, and controls for appointments, prioritizing citizens and children of female citizens for appointments. Non-citizens may be appointed on contracts as per executive regulations.

Additionally, the Decree-Law covers employment systems, employee training and qualification, performance evaluation, and legal provisions regarding the formation of specialized committees, bonuses, promotions, and status settlement. It also addresses working hours, leave entitlements, transfers, secondment, loan, and overtime.

Legal provisions within the Decree-Law define the system of job discipline and work conduct, guarantees, liability for administrative violations, investigation procedures, administrative penalties, lapse of violations and grievances, end-of-service benefits, validity of delegation, final provisions, and enforcement and publication.
